This Privacy Policy explains how Enexus Distribution Pty Ltd (ABN 25 692 297 644) (“Enexus”, “we”, “us”, “our”) collects, uses, discloses and protects your personal information.

We are committed to handling personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs), to the extent they apply to us, and with other applicable privacy laws.

This policy applies to:

  • visitors to our websites and online platforms

  • installer, reseller and customer contacts

  • supplier and partner contacts

  • people who interact with us about projects, support, warranty and returns

  • job applicants and other individuals we deal with in the course of our business.

If you do not agree with this policy, please do not provide us with personal information and contact us if you have questions.

2. What is “personal information”?

In this policy, personal information means information or an opinion about an identified individual, or an individual who is reasonably identifiable, whether the information is true or not and whether recorded in a material form or not, in line with the Privacy Act definition.

We do not generally collect sensitive information (such as health information, information about your racial or ethnic origin, or criminal history). If we ever need to collect sensitive information, we will do so only with your consent or where required or authorised by law.

3. What personal information we collect

The types of personal information we may collect include:

3.1 Business contact and identity details

  • name

  • position or job title

  • business name

  • business email address and phone number

  • business postal and site addresses.

3.2 Customer, supplier and partner information

  • order and transaction details

  • warranty and RMA records

  • communication history with our sales, technical or accounts teams

  • preferences for products, services and communication.

3.3 Website, device and usage data

When you visit our website or interact with our online platforms, we may collect:

  • IP address and approximate location

  • device identifiers and browser type

  • pages viewed, time on site and navigation patterns

  • referral source (e.g. how you came to our website)

  • information from cookies and similar technologies (see section 6).

3.4 Support, commissioning and technical information

  • technical logs and configuration data supplied by you or your installer

  • details of your environment required for troubleshooting (for example, network configuration, site conditions)

  • error codes, diagnostic information and photos relating to installed hardware.

3.5 Job applicants

If you apply for a role with us, we may collect:

  • CV/resume and cover letter

  • employment history and qualifications

  • referee details

  • other information you choose to provide during recruitment.

3.6 Credit‑related information (for trade credit)

If you or your business apply for a trade credit account with Enexus, we may collect credit‑related information about individuals associated with that application (for example, directors or guarantors). This may include identification details, information about your credit history and payment performance, and information from credit reporting bodies. See section 8 for more detail.

4. How we collect personal information

We collect personal information in a number of ways, including:

  • Directly from you – when you:

    • make an enquiry, request a quote or place an order

    • sign up for an account, newsletter or event

    • contact us by phone, email, online form or in person

    • request technical support, warranty or RMA assistance

    • apply for a trade credit account

    • apply for a job with us.

  • From your employer or organisation – where you are a contact person for a customer, installer, reseller, supplier or partner and they provide your details to us.

  • Automatically – when you visit our websites or use our online services, we may collect usage, device and cookie data (see section 6).

  • From third parties, such as:

    • our distributors, installers, resellers and integration partners

    • OEMs and technology partners involved in a project

    • credit reporting bodies and trade referees (for credit applications)

    • recruitment agencies and referees (for job applicants).

We collect personal information in a way that is lawful and fair and, where reasonable and practicable, directly from you.

5. Why we collect, use and disclose personal information

We collect, hold, use and disclose personal information for purposes including:

5.1 Supplying products and services

  • processing and fulfilling orders

  • managing deliveries and logistics

  • providing installation guidance and technical support

  • handling warranty and RMA requests

  • managing accounts and billing.

5.2 Business operations

  • managing relationships with customers, installers, resellers and suppliers

  • planning and delivering projects

  • improving our products, services and support processes

  • training our staff and maintaining quality assurance.

5.3 Marketing and communication

  • sending product updates, technical bulletins and event invitations

  • letting you know about new products, services or promotions that may be relevant to your role or business

  • managing your marketing preferences and opt‑outs.

5.4 Credit management

  • assessing applications for trade credit

  • managing credit accounts and collecting payments

  • providing information to credit reporting bodies and trade referees, as allowed by law (see section 8).

5.5 Legal, risk management and compliance

  • complying with legal and regulatory obligations

  • responding to subpoenas, court orders or lawful requests from government or regulators

  • preventing, investigating or managing fraud, security incidents or misconduct

  • managing disputes, complaints and claims.

8. Credit‑related information (for trade credit accounts)

If you or your business apply for a trade credit facility with Enexus, we may collect, use and disclose credit‑related information about individuals including:

  • identification details of applicants, directors, partners or guarantors

  • information about your dealings with us (such as payment history)

We may use this information to:

  • assess applications for commercial credit

  • manage your credit account and collect overdue payments

  • manage credit risk and help prevent fraud.

We may disclose credit‑related information to:

  • credit reporting bodies

  • our debt collection agencies

If we share your information with credit reporting bodies, they may include that information in the credit reports they provide to other credit providers, as permitted by law.

9. Who we share personal information with

We may disclose your personal information to:

  • OEMs, manufacturers and technical partners involved in supplying, supporting or servicing the hardware you purchase

  • logistics, warehousing and freight providers

  • professional advisers (for example, lawyers, accountants, auditors and insurers)

  • IT, telecommunications and cloud service providers who host or support our systems

  • government agencies, regulators, law enforcement or courts where required or authorised by law

  • parties involved in a business transaction, such as the sale or restructure of Enexus (subject to confidentiality obligations).

We require third parties who receive personal information from us to handle it in a way that is consistent with this policy and with applicable privacy laws.

10. Overseas disclosures

Some of the third parties we share information with, or the systems we use, may be located outside Australia or store data overseas. This may include, for example:

  • OEMs and service partners based overseas

  • cloud hosting, collaboration and CRM providers with data centres in other countries.

The countries where personal information may be stored or accessed will depend on the particular services and providers we use from time to time. These may include New Zealand, countries in the European Union, the United States, Singapore or others.

Where we disclose personal information overseas, we take reasonable steps to ensure the recipient will handle it in a manner consistent with this policy and the APPs.

11. Security and retention of personal information

We take reasonable steps to protect personal information from:

  • misuse, interference and loss; and

  • unauthorised access, modification or disclosure.

Measures we use include:

  • physical security for our premises and equipment

  • access controls, authentication and role‑based permissions on systems

  • encryption and secure transmission where appropriate

  • staff training and confidentiality obligations

  • policies and procedures for information security and incident response.

We keep personal information for as long as reasonably necessary:

  • to provide our products and services

  • to manage our relationship with you

  • for our internal accounting and audit requirements

  • to comply with legal, regulatory and contractual obligations

  • to manage actual or potential disputes.
